1. Who we are and what these Terms cover
These Terms of Use (“Terms”) govern the access to and use of the eTrilhas platform — the Android and iOS app and the website etrilhas.com.br, as well as the services and events offered under the eTrilhas brand (together, the “Platform”). The Platform is operated by Plataforma eTrilhas LTDA, registered under CNPJ No. 60.107.731/0001-62, headquartered at Av. Raja Gabaglia, No. 1,617, Suite 501, Luxemburgo neighborhood, ZIP 30.380-435, Belo Horizonte/MG, Brazil (“eTrilhas”, “we”).
By accessing or using the Platform, you declare that you have read, understood and agree to these Terms and to our Privacy Policy, which is an integral part of them. If you do not agree, do not use the Platform.
Some features may have specific conditions that supplement these Terms and, in the event of conflict, prevail over them in what is specific. Trail manager accounts have their own terms for the use of the administrative panel.
2. What the Platform offers
eTrilhas is a community-based, free-to-use platform that lets you discover trails and natural areas, view maps and technical sheets, record routes via GPS, log check-ins, build a trail passport, review trails, send issue reports and alerts to the responsible managers, and use content offline.
The Platform may also display information about local guides and service providers. Contacting and any hiring of these services happen directly between you and the provider, outside the Platform; eTrilhas does not act as an intermediary, is not a party to these relationships and is not responsible for them.
Use of the Platform is free. Access may depend on an internet connection and on your device; data and telecommunications costs are your responsibility, according to your provider or carrier.
We may, at any time, change, expand, limit, suspend or discontinue Platform features, in whole or in part, seeking to notify you when the change is relevant.
3. Who can use it
The Platform may be used by natural persons. Children and adolescents may use it, and use by minors must take place with the guidance and supervision of parents or guardians, especially in features that involve location and outdoor activities. The processing of data of children and adolescents follows the Privacy Policy and applicable law.
Use of the Platform is intended for personal, non-commercial purposes. It is forbidden to use the Platform to sell products or services, run unauthorized advertising or drive traffic for commercial purposes. Managers of natural areas and partners with institutional or commercial purposes must use the specific accounts offered by eTrilhas, subject to their own terms.
4. Your account
To use most features, you need to create an account, providing true, complete and up-to-date information. You can register with email and password or through your Google or Apple account.
- You are responsible for keeping your password confidential and for all activities carried out under your account.
- Notify us immediately, through the channels in section 16, if you identify unauthorized use of your account.
- Do not use as a username the name of third parties, trademarks without authorization or offensive terms.
- Each person must keep a single account and must not use another person’s account.
We may refuse, suspend or terminate accounts that violate these Terms or the law, as set out in section 12.
5. Rules of use
When using the Platform, you agree not to:
- violate the law, third-party rights or these Terms;
- publish unlawful, offensive, defamatory, discriminatory, violent or pornographic content, or content that infringes copyright or image rights;
- insert viruses or malicious code, or attempt to compromise the security, stability or operation of the Platform;
- use bots, scrapers or other automated means to access, copy or monitor the Platform without our express authorization;
- reproduce, distribute or commercially exploit the Platform’s content without authorization;
- impersonate another person or interfere with other users’ use of the Platform;
- access restricted areas or attempt to obtain other users’ data improperly.
You are responsible for respecting the rules of the places you visit, private property, signage and the guidance of managers and authorities, acting with care for the environment and for other people.
6. User content
The Platform allows you to publish content such as reviews, comments, photos, videos, check-ins, reports and routes (“User Content”). You are solely responsible for the User Content you publish, including its legality and accuracy.
By publishing, you represent and warrant that: (i) you hold the rights to the content or have the necessary authorizations; and (ii) the publication does not violate third-party rights, including copyright, image and privacy rights. If the content contains another person’s image, voice or data, you must have obtained their authorization — with special attention when it involves children and adolescents.
eTrilhas hosts the User Content and has no obligation to monitor it in advance, but may, at its discretion and as permitted by law, remove or restrict content that violates these Terms, the law or third-party rights. You may request the removal of your content through the channels in section 16.
7. License over your content
You remain the owner of the User Content you publish. By making content public on the Platform, you grant eTrilhas a non-exclusive, royalty-free, worldwide license, valid for as long as the content remains published, to host, reproduce, technically adapt (e.g., adjust resolution), translate, display and distribute that content on the Platform, for the purpose of operating and improving it.
This license also covers the use of public content in activities to publicize and promote the Platform — for example, on social media and eTrilhas communication materials. In such promotional cases, eTrilhas will credit you as the author, associating your display name with the respective content.
The license does not transfer ownership of your content and ends, as a rule, when you remove it or delete your account, except for backup copies and the retentions provided for in the Privacy Policy and the law, as well as content that other users have already legitimately saved or shared outside the Platform.
8. eTrilhas intellectual property
The Platform and its original content (excluding User Content) — including software, texts, design, trademarks, logos, databases and other elements — belong to eTrilhas or its licensors and are protected by intellectual property law. You receive a limited, personal, non-exclusive and non-transferable license to use the Platform under these Terms, and you do not acquire any rights over these elements.
It is forbidden to copy, modify, distribute, decompile, reverse engineer or create derivative works of the Platform, except to the extent expressly permitted by law. The eTrilhas trademarks and visual identity may not be used without our prior written authorization.
9. Maps, third-party data and safety on the trails
The Platform uses map layers and data from external providers (such as Mapbox and the Leaflet library, as well as data from open sources such as OpenStreetMap). Access to this content depends on agreements with the providers and may be changed or discontinued for reasons beyond our control; we will seek alternatives when this happens.
Information about trails — including routes, distances, difficulty and conditions — is for informational purposes, may contain inaccuracies or be outdated and should not be used as the sole reference, especially in risk situations. Outdoor activities involve risks of injury, death and material damage.
You are solely responsible for assessing, before and during the activity, your physical condition, your equipment, the weather and terrain conditions, any closures or interdictions and the guidance of managers and authorities. The Platform is not safety equipment nor an emergency service; in case of risk, contact the emergency services in your region.
10. Third-party content and links
The Platform may contain third-party content (such as information from managers and providers) and links to external sites and services. We do not control and are not responsible for such content, sites or services, nor for their privacy practices. We recommend reading the terms and policies of each service you access.
11. Automatic translation and AI features
The Platform may offer features based on artificial intelligence, such as review summaries, trail suggestions and automatic translation of public content into other languages. These features are offered for convenience, “as is”, may contain inaccuracies and do not replace verification by you. The original language of the content is the one in which it was published by the author; in the event of divergence, the original version prevails.
12. Suspension and termination
You may close your account at any time, using the feature available on the Platform or by requesting it through the channels in section 16.
We may suspend or terminate your access, with notice where appropriate, if you breach these Terms or the law, or if there are signs of unlawful or abusive use that is harmful to the Platform or to third parties. Once the account is closed, your right to use it ceases; the processing of your data after closure follows the Privacy Policy.
13. Disclaimers and limitation of liability
The Platform is provided “as is” and “as available”. We do not guarantee that it will always be available, error-free or uninterrupted, nor that trail information is accurate, complete or fit for a particular purpose. We may suspend access for maintenance, updates or correction of faults.
To the maximum extent permitted by applicable law, eTrilhas is not liable for damages arising from: unavailability or technical failures of the Platform; the conduct of third parties, including other users, managers and providers; inaccuracy of trail information or third-party content; and improper use of the Platform by you.
Nothing in these Terms removes rights that Brazilian consumer law guarantees on a non-waivable basis, nor liability for willful misconduct. The other limitations apply within the limits of the Consumer Protection Code and applicable law.
14. Changes to these Terms
We may update these Terms to reflect changes in the Platform or in the law. In the event of relevant changes, we will notify you through the app, the website or by email before they take effect, and we will indicate the new effective date. Continued use of the Platform after the changes take effect represents your agreement with the new Terms. If you do not agree, stop using the Platform.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be settled in the courts of the district of Belo Horizonte/MG, without prejudice to the jurisdiction rules applicable to consumer relations, which allow the consumer to file suit in the courts of their own domicile. If any provision of these Terms is held invalid, the remaining provisions will remain in force.
